A complaint file is from Review & Investigation Division or Alternative Dispute Resolution Division for drafting charges of Professional Misconduct.
Counsel then drafts an Affidavit of Charge highlighting specific Professional Misconduct offences committed by the advocate.
The Affidavit of Charge is thereafter filed at the Advocates Disciplinary Committee /Tribunal.
The charge is then assigned a Disciplinary Cause/Case Number and listed for plea taking by the Advocates Disciplinary Committee/Tribunal after a successful prima facie case has been established.
After plea taking, the case proceeds to hearing with the Commission appearing on behalf of the complainants.
The Advocates Disciplinary Committee/Tribunal thereafter delivers its Judgment and or findings on the Professional Misconduct.
The Commission follows up on compliance with the Sentence/orders of the Advocates Disciplinary Committee/Tribunal.
